Plaintiff filed this action in the San Diego Superior Court on June 10, 2008 seeking unreimbursed expenses and wages for amounts deducted from commissions on behalf of all California Account Executives.
Presently, both sides are preparing for a hearing to determine whether the case should proceed forward as a class action. We must show the Court that there are sufficient common issues to support class certification. The Court has ordered that Plaintiff file his Motion for Class Certification by April 3, 2009, and the hearing is scheduled for May 1, 2009 at 9:00 a.m. in Dept. 67 of the San Diego Superior Court, Hall of Justice located at 330 W. Broadway, San Diego, CA 92101. In the meantime, the parties have agreed to attempt to resolve the case prior to the class certification process and will be mediating on March 3, 2008 with highly respected mediator, the Honorable Edward A. Infante (Retired), former Chief Magistrate Judge of the U.S. District Court, Northern District of California.
We would like to speak with anyone who has been employed by RBS Lynk as an Account Executive in the State of California at anytime since June 10, 2004 to discuss business expenses incurred and amounts deducted from wages or commissions to prepare for the class certification process as well as mediation.
